Wake Up, Mr West!

“Everybody wanted to know what I would do if I didn’t win. I guess we’ll never know.”

Kanye West’s infamous 2005 Grammy acceptance speech captured a pivotal moment in hip-hop history. Celebrated as one of the greatest producers of all time, West built his sound on sampling—a practice that would later make him one of music’s most frequent copyright infringement defendants.

Sampling has been foundational to hip-hop since its inception. The creative recontextualization of R&B and soul compositions—paired with hard, belligerent lyrics—has produced countless hits and shaped global music culture. West’s debut single “Through The Wire” sampled Chaka Khan’s “Through the Fire,” establishing a pattern he’d continue throughout his career under the protection of U.S. fair use laws.

But in September 2020, West posted his Universal Music Group contract during a label dispute. The document revealed a critical clause: West was permitted to sample, provided he secured proper clearances. This was a clause West repeatedly ignored. With over 10 copyright infringement lawsuits filed against him, it’s easy to dismiss this as typical celebrity behavior.

The reality is more serious than headlines suggest.

Copyright infringement carries inevitable consequences beyond lawsuits and financial damages. At its core, it means someone’s creative work, passion, and intellectual property has been used without permission or compensation. The irony isn’t lost—West, whose entire career demonstrates how derivative work can achieve massive success, has built his empire partly on uncredited foundations.

The solution isn’t to stop sampling. It’s to create systems where composers and authors are properly acknowledged and compensated, making legal sampling accessible so everyone benefits from the creative exchange.
